Beware of Bogus Stamp Duty Land Tax (SDLT) Refund Claims

HMRC has warned property buyers about unscrupulous agents offering to reclaim Stamp Duty Land Tax (SDLT).  They argue a house was non-residential due to being uninhabitable due to its state of disrepair.

 

In reality, a property is still classed as residential if it's intended to be lived in, even if it does needs work doing to it. Most of these refund claims are incorrect and can lead to:

 

  • Repayment of the full SDLT

  • Interest and penalties 

  • High agent fees
